1. Acceptance of These Terms

By accessing our website, registering an account or completing a purchase, you agree to these Terms and to any policies referenced within them, including our Privacy Policy and Returns Policy. Together they govern your relationship with us. If you are placing an order on behalf of a business or another person, you confirm that you have the authority to do so and to bind them to these Terms.

We may update these Terms from time to time to reflect changes in our business, technology or the law. The version that applies to your order is the one published on our website at the time you place that order; changes are not applied retrospectively to orders we have already accepted. The current version is dated 8 June 2026, and we encourage you to review this page periodically.

2. Eligibility & Your Account

To place an order you must be at least 18 years old and legally able to enter into a binding contract under Malaysian law. By ordering, you confirm that you meet these requirements and that the information you give us is accurate and complete.

If you create an account, you are responsible for keeping your login details confidential and for all activity that takes place under your account. We are not liable for any loss arising from unauthorised use of your account where you have failed to keep your credentials secure, but nothing in these Terms limits our own responsibilities under the Personal Data Protection Act 2010.

• Provide accurate, current and complete information when registering and at checkout.
• Keep your password secure and do not share your account with others.
• Notify us promptly at setiajayakita@gmail.com if you suspect any unauthorised use of your account.
• We may suspend or close accounts that are used in breach of these Terms or applicable law.

3. Products, Descriptions & Pricing

We take care to describe our products accurately, including specifications, images and prices in Ringgit Malaysia (RM). However, product images are for illustration only, and slight differences in colour, packaging or accessories may occur. Manufacturer specifications may also change without notice, and product availability is not guaranteed until your order is accepted.

All prices are displayed in RM and, unless stated otherwise, are inclusive of any applicable taxes. Delivery charges, where they apply, are shown separately at checkout before you confirm your order. Despite our best efforts, occasional errors in pricing or descriptions can occur. Where we discover an error in the price or description of a product you have ordered, we are not obliged to supply it at the incorrect price; we will contact you before processing the order so you may choose to confirm it at the correct price or cancel it for a full refund of anything already paid.

4. Orders, Contract Formation & Payment

When you place an order, you are making an offer to buy the selected products under these Terms. We will send you an acknowledgement email confirming that we have received your order. This acknowledgement does not, by itself, mean we have accepted your order. A binding contract is formed only when we send you a separate confirmation email stating that your order has been accepted and is being prepared for dispatch.

Until acceptance, we may decline or cancel an order, for example if a product is out of stock, if a pricing or description error is found, if we are unable to verify your payment details, or if we reasonably suspect fraud or a breach of these Terms. Online transactions are recognised under the Electronic Commerce Act 2006, and your electronic acceptance of these Terms is treated as valid and enforceable.

Payment is due in full at the time you place your order, using one of the payment methods offered at checkout, and is processed in Ringgit Malaysia (RM). We accept your order on the basis that payment has been successfully received and authorised. If your payment is declined or later reversed, we may cancel the order or suspend delivery until payment is resolved. We do not store full card details on our own systems; payments are handled by trusted third-party payment providers under their own terms and security standards.

5. Delivery, Risk & Title

We offer tracked, door-to-door delivery across Malaysia so you can follow your parcel from dispatch to your doorstep. Orders over RM 500 qualify for free next-day delivery; for orders of RM 500 or less, any delivery charge is shown at checkout before you pay. Delivery timeframes, including next-day delivery, are targets rather than guarantees and may be affected by your location, stock availability, public holidays or circumstances beyond our reasonable control.

Risk in the products passes to you when they are delivered to the address you provided. Legal ownership (title) of the products passes to you once we have received payment in full and the products have been delivered, whichever is later. Please inspect your delivery on arrival and contact us promptly at setiajayakita@gmail.com if anything is missing, incorrect or damaged so we can put it right.

6. Warranty, Returns & Cancellations

Every product we sell comes with a 2-year warranty, backed by the manufacturer, covering defects in materials and workmanship under normal use. This warranty is in addition to, and does not take away from, your rights under Malaysian consumer law. To make a warranty claim, contact us at setiajayakita@gmail.com with your order details and a description of the issue. The warranty does not cover normal wear and tear, accidental damage, misuse, unauthorised repairs or modifications, or damage caused by failing to follow the manufacturer's instructions.

You may also return eligible products within 14 days of delivery for a refund or exchange, provided they are unused, in their original condition and complete with all packaging and accessories. To start a return, email us at setiajayakita@gmail.com and we will guide you through the process. Full details are set out in our Returns Policy. We may cancel an order before dispatch if a product is unavailable, a pricing or description error is found, payment cannot be verified, or we reasonably suspect fraud or a breach of these Terms; if we cancel an order you have already paid for, we will refund you in full. Nothing in this section limits your statutory rights under the Sale of Goods Act 1957 or the Consumer Protection Act 1999.

• Warranty: 2 years from delivery, manufacturer-backed, covering defects in materials and workmanship.
• Return window: 14 days from the date of delivery for change-of-mind returns.
• Items must be unused and in original, resaleable condition with all packaging and accessories.
• Refunds are issued to your original payment method once the returned item is received and inspected.
• Faulty or misdescribed products may be returned in line with your statutory rights, separate from the 14-day window.

7. Promotions, Vouchers & Discount Codes

From time to time we may offer promotions, vouchers, welcome offers or discount codes (such as a discount on your first order). Unless we state otherwise, each promotion is subject to availability, is valid only for the period advertised, applies to eligible products only, cannot be exchanged for cash, and cannot be combined with other offers.

We may withdraw, amend or refuse to apply any promotion, voucher or code if we reasonably believe it is being used in error, in bad faith, in breach of its specific terms, or fraudulently. Where a discount is applied to an order that is later cancelled or returned, any refund will reflect the actual amount you paid after the discount.

8. Intellectual Property & Acceptable Use

All content on our website, including text, logos, product images, graphics, layout and design, is owned by or licensed to Setia Jaya Kita Sdn Bhd and is protected by applicable intellectual property laws. You may view and use our website for your own personal, non-commercial purposes, but you may not copy, reproduce, republish, distribute or otherwise exploit any of our content without our prior written permission. Product brand names and trademarks remain the property of their respective owners.

You agree to use our website lawfully and not in any way that could damage, disable or impair it, or interfere with another person's use of it. Our website may contain links to third-party sites for your convenience; we do not control and are not responsible for the content, products or privacy practices of those sites, and accessing them is at your own risk.

• Do not use the website for any fraudulent, unlawful or harmful purpose.
• Do not attempt to gain unauthorised access to our systems, accounts or data.
• Do not introduce viruses, malware or any other harmful or disruptive code.
• Do not scrape, harvest or misuse content or personal data from the website.
• Do not place orders using false details or someone else's payment method without authority.

9. Consumer Rights, Privacy, Liability & Indemnity

Nothing in these Terms excludes or limits your rights as a consumer under Malaysian law, including the Consumer Protection Act 1999 and the Sale of Goods Act 1957. These statutory rights apply in addition to our warranty and returns policy and cannot be signed away. We handle your personal data in accordance with the Personal Data Protection Act 2010 (PDPA), using it only as set out in our Privacy Policy.

To the fullest extent permitted by law, and without affecting your statutory consumer rights, Setia Jaya Kita Sdn Bhd is not liable for indirect, incidental or consequential losses, or for loss of profit, data or business, arising from your use of our website or any order. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded under Malaysian law. Subject to the above, our total liability for any order is limited to the amount you paid for the products in that order. You agree to indemnify us against reasonable losses, claims and costs we incur arising directly from your breach of these Terms, your misuse of our website, or your infringement of the rights of any third party.

10. Force Majeure & General Terms

We are not responsible for any delay or failure to perform our obligations where this is caused by events beyond our reasonable control, such as natural disasters, severe weather, fire, flood, epidemics or pandemics, strikes, civil disturbances, government actions, power or telecommunications failures, or disruptions affecting our suppliers or delivery partners. If such an event occurs, we will let you know and aim to limit any disruption, and where delivery is significantly delayed you may contact us at setiajayakita@gmail.com to discuss options, including cancellation and a refund of any amount paid for undelivered products.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not transfer or assign your rights or obligations under these Terms without our consent, but we may assign ours to a successor or affiliate without affecting your rights. These Terms, together with our Privacy Policy and Returns Policy, form the entire agreement between you and us regarding your use of our website and your orders. Consistent with the doctrine of privity under Malaysian law, these Terms do not create any rights enforceable by a person who is not a party to them.

These Terms, and any dispute or claim arising from or connected with them or your use of our website, are governed by and interpreted in accordance with the laws of Malaysia, and you and Setia Jaya Kita Sdn Bhd submit to the exclusive jurisdiction of the courts of Malaysia. If you have a complaint, please contact us first at setiajayakita@gmail.com so we can try to resolve it. As a consumer, you may also be entitled to refer eligible claims to the Tribunal for Consumer Claims Malaysia, established under the Consumer Protection Act 1999.
